The scope and variety of forms of data processing and exchange nowadays are constantly growing. However, this means that data protection and data security requirements are also growing. Data protection protects citizens' personality rights concerning the handling of personal data. The Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG), the data protection laws of the individual federal states (State Data Protection Act, LDSG), as well as other legal requirements (e.g. Telemedia Act (TMG), Telecommunications Act (TKG), Law Against Unfair Competition (UWG), etc.) form the main legal basis of this.
Fines of up to € 300,000 can be imposed for loss of data or for improper or negligent handling of personal data. Companies at which more than nine employees work in automated personal data processing must appoint a data protection officer.
